You want to make sure your spouse is looked after, but you also want to guarantee your children eventually inherit your share of the assets. Your partner can live in the home and benefit from the income, but the capital value remains locked down for your children.

2. If you are Unmarried Co-habitants — The "Discretionary" Trust

You want to support your partner, but passing assets directly to them can cause tax issues or risk the money eventually going to their family instead of yours. A flexible Trust lets Trustees support your partner while keeping your wealth ring-fenced for your family.

What's Not Included (Available If You Need Them)

Our fixed fee covers the Trust Will itself. The following additional work may be required depending on your circumstances, and Aaron will discuss these with you and agree a separate fixed fee before any work begins:

  • Severance of Beneficial Joint Tenancy — if your property is held as Joint Tenants, it must be severed to Tenants in Common for the Trust to work (quoted separately)
  • Declaration of Trust — if you need to specify unequal shares in the property (quoted separately)
  • Letter of Wishes — guiding your Trustees on how to exercise their discretion (quoted separately)
  • Statement Excluding a Beneficiary — a formal record protecting your Will from challenge (quoted separately)
  • Solicitor Capacity Assessment — if there are concerns about mental capacity (quoted separately)
  • Complex tax advice or dealing with foreign assets (quoted separately)

Your situation may be entirely straightforward and not require any of these. Aaron will explain which apply during your consultation.

What Happens If You Don't Act?

Without a Trust Will, your share of the family home could be claimed by care fees, lost to a new partner's family, or dragged into a beneficiary's divorce or bankruptcy. A standard Will offers no protection against these risks — a Trust Will does.

Required disclosures for Trust Wills (Single)

Included: The fixed fee covers taking instructions, drafting a Trust Will (incorporating the appropriate Trust structure), and supervising the execution of the document.

Excluded: This fee does not include the legal work to Sever the Joint Tenancy or register restrictions at the Land Registry, which are quoted separately if required. It also excludes Declarations of Trust, Letters of Wishes, Statements of Exclusion, Capacity Assessments, complex tax advice, or dealing with foreign assets.

Important Note: A separate client onboarding fee of £35 + VAT per person applies to all new instructions to cover ID verification and file setup.
